Hunting License Verification Waiver
PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A VERIFICATION OF YOUR RESPONSIBILITY TO POSSESS A VALID SOUTH DAKOTA HUNTING LICENSE.
In consideration of being permitted to participate in duck hunting and related activities (collectively, the “Activities”) provided by J&J OutdoorZ LLC (“J&J OutdoorZ”), including but not limited to the rental and use of duck blinds and access to private lands in and around Webster, South Dakota, I, the undersigned participant, acknowledge and agree to the following terms:
1. Verification of Valid Hunting License
I certify that I possess a valid and appropriate South Dakota hunting license for the type of hunting I intend to engage in during the rental period with J&J OutdoorZ LLC. This includes, but is not limited to, the appropriate licenses, permits, stamps, or tags required by the South Dakota Game, Fish and Parks Department for waterfowl hunting or any other hunting activities conducted during the duration of my rental with J&J OutdoorZ LLC.
2. Compliance with Hunting Regulations
I agree to comply with all federal, state, and local laws, regulations, and ordinances governing hunting in South Dakota, including but not limited to those set forth in South Dakota Codified Laws Title 41 and regulations issued by the South Dakota Game, Fish and Parks Department. I understand that failure to possess a valid hunting license or to comply with applicable regulations may result in my immediate removal from the Activities without refund and may subject me to fines, penalties, or other legal consequences.
3. Presentation of License
I agree to present my valid South Dakota hunting license, along with any required permits, stamps, or tags, to J&J OutdoorZ LLC staff upon request prior to or during the Activities. I understand that J&J OutdoorZ LLC reserves the right to deny access to the Activities if I fail to provide proof of a valid and appropriate hunting license.
4. Acknowledgment of Responsibility
I acknowledge that it is my sole responsibility to ensure that my hunting license is current, valid, and appropriate for the type of hunting I intend to conduct. J&J OutdoorZ LLC is not responsible for verifying the validity of my license or ensuring my compliance with South Dakota hunting laws.
5. Indemnification
I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS J&J OutdoorZ LLC, its owners, officers, employees, agents, affiliates, or property owners from any and all claims, liabilities, losses, damages, or expenses (including reasonable attorney’s fees) arising from my failure to possess a valid and appropriate South Dakota hunting license or my violation of any federal, state, or local hunting laws or regulations.
6. Voluntary Execution
I certify that I have read and fully understand this Hunting License Verification Waiver. I am signing this Agreement voluntarily and without duress, and I acknowledge that I have had the opportunity to consult with legal counsel before signing.
Liability Waiver and Release Agreement
PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.
In consideration of being permitted to participate in duck hunting and related activities (collectively, the “Activities”) provided by J&J OutdoorZ LLC (“J&J OutdoorZ”), including but not limited to the rental and use of duck blinds, decoys and any other equipment, I, the undersigned participant, acknowledge and agree to the following terms:
1. Acknowledgment of Risks
I understand that the Activities involve inherent risks, dangers, and hazards, including but not limited to:
Physical injury or death due to the use of firearms, ammunition, or hunting equipment.
Accidents or injuries caused by uneven terrain, water hazards, weather conditions, or wildlife encounters.
Equipment failure, including but not limited to duck blinds, boats, or other rental equipment.
Exposure to extreme weather conditions, including cold, heat, wind, rain, or snow.
Personal injury or property damage caused by the actions or negligence of myself, other participants, or third parties.
Other risks associated with outdoor recreational activities, including slips, falls, or collisions.
I acknowledge that these risks may result in serious injury, death, or property damage, and I voluntarily assume all such risks.
2. Release and Waiver of Liability
To the fullest extent permitted by law, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE J&J OutdoorZ LLC, its owners, officers, employees, agents, affiliates, or property owners (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me or my property while participating in the Activities, whether caused by the negligence of the Released Parties, myself, other participants, or otherwise.
3. Indemnification
I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any and all claims, liabilities, losses, damages, or expenses (including reasonable attorney’s fees) arising from my participation in the Activities, including those resulting from my own actions, negligence, or failure to follow instructions, safety guidelines, or applicable laws.
4. Assumption of Responsibility
I certify that I am physically and mentally capable of participating in the Activities and that I have no health conditions that would prevent safe participation. I agree to comply with all federal, state, and local laws, including hunting regulations, and to follow all safety instructions and guidelines provided by J&J OutdoorZ LLC. I understand that failure to comply may result in my removal from the Activities without refund.
5. Equipment and Property Use
I acknowledge that any equipment or property provided by J&J OutdoorZ LLC (e.g., duck blinds, decoys, or other gear) is used at my own risk. I agree to inspect all equipment before use and to notify J&J OutdoorZ LLC immediately of any defects or safety concerns. I am responsible for any damage to equipment or property caused by my misuse or negligence, and I agree to reimburse J&J OutdoorZ LLC for any such damages.
6. Photographic Release
I grant J&J OutdoorZ LLC permission to use photographs, videos, or other media taken during the Activities for promotional or marketing purposes without compensation to me.
7. Governing Law and Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of South Dakota. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Voluntary Execution
I certify that I have read and fully understand this Agreement. I am signing this Agreement voluntarily and without duress, and I acknowledge that I have had the opportunity to consult with legal counsel before signing.
